1. Agreement

These Terms & Conditions are a legal agreement between you and Rajat Gupta ("we", "us" or "our") for the use of the FitCoach app and website (the "Service"). By creating an account or continuing to use the Service, you agree to these terms. If you do not agree, do not use the Service.

2. The Service

FitCoach provides personalised AI-generated meal plans, workout suggestions, progress tracking, water reminders and related fitness content. Plans are informational and are not medical, dietary or professional fitness advice. Always consult a qualified professional before making major changes to your diet or exercise routine.

3. Your account

You must sign in with a Google or Apple account. You are responsible for keeping that account secure and for all activity that happens under your account. You must be at least 18 years old, or have permission from a parent or guardian, to use the Service.

4. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• send spam, harass others, or upload harmful content;
• infringe our or anyone else's intellectual property rights;
• interfere with the Service's security, reverse engineer it, or scrape data;
• share account credentials or attempt to bypass access controls.

5. Intellectual property

All content, software, branding and materials in the Service are owned by Rajat Gupta or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal fitness goals. You may not copy, modify, distribute or resell any part of the Service.

6. Payments and subscriptions

FitCoach offers a 7-day free trial, followed by a monthly or annual subscription. Payments, billing, tax, subscription management, cancellations and refunds are handled by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders and provides customer service inquiries and handles returns.

By subscribing, you agree to Paddle's Buyer Terms. Subscriptions automatically renew unless cancelled before the renewal date. You can cancel through your Paddle account or by contacting Paddle support.

7. Refunds

We offer a 30-day money-back guarantee. If you are not satisfied, you may request a refund within 30 days of your order date. Refunds are processed by Paddle. To request a refund, visit paddle.net or contact our support team at support@fitcoach.app.

8. Termination and suspension

We may suspend or terminate your access if you materially breach these terms, fail to pay when due, create a security or fraud risk, or repeatedly violate our policies. You may stop using the Service and delete your account at any time.

9. Disclaimers and liability

The Service is provided "as is" without warranty of any kind. We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, consequential or special damages.

10. Governing law

These terms are governed by the laws of India. Any dispute will be resolved in the courts of New Delhi, India.

11. Changes

We may update these Terms & Conditions from time to time. Continued use of the Service after changes means you accept the updated terms.
